18.1.99 PS The Panel discussed with the Administration on its proposal to introduce the non-civil service contract terms for Heads of Department or Heads of Grade to employ non-civil service contract (NCSC) staff at non-directorate equivalent level with a view to improving the existing arrangements for employment of temporary and short-term contract staff. 16.4.99 FC FC discussed with the Administration on issues relating to the Social Welfare Department's (SWD) employment of new recruits at 70% of the starting salary of comparable civil service ranks and the control over the use of approved funds.

Members expressed concern that such recruitment practice might be inconsistent with the power given to the Government when the Legislative Council approved the Estimates of Expenditure and might induce other departments to follow suit. Some members were also concerned about the effect of SWD's hiring on subvented non-government organizations. FC Chairman suggested that further questions on the issue should be followed up by the PS Panel and the Welfare Panel.

7.5.99 FC FC discussed with the Administration on its proposal of granting supplementary provision to Architectural Services Department, Census and Statistics Department (CSD), Department of Health, Education Department (ED), SWD and Water Supplies Department to employ additional NCSC staff or hire service to meet service needs. While not objecting to the entire proposal, Hon LEE Wing-tat disagreed with the request for supplementary provision in respect of SWD. He suggested that consideration of the proposal should be deferred and that the Administration should present the case of the six departments in different papers to facilitate FC's consideration. In this connection, he moved a motion at the meeting to adjourn the discussion on the item. The adjournment motion was negatived. The item was subsequently approved by FC. [Minutes]

17.5.99 PS The Panel followed up the discussion with the Administration on SWD's employment of NCSC staff at 70% of the starting salary of comparable civil service ranks. [Paper]

At the request of members, the Administration provided supplementary information on the employment of NCSC staff for the period 7.1.99 to 24.5.99 with breakdown by departments. [Follow-up paper]

27.1.00 MP The Panel discussed with the Administration on the application of Employment Ordinance (EO) to employees who worked less than 18 hours per week and persons engaged under contracts for service and government employees on NCSC terms. [Paper]

At the request of members, the Administration provided supplementary information on the pattern of employment of part-time employees who were working without a continuous contract in five named large companies. [Follow-up paper]

3.00 FC Further to the approval by FC at the meeting on 7.5.99, the Administration provided an information note to FC members on the details of the supplementary provision to departments for employment of NCSC Staff or hire of services. In view of the smaller than originally expected number of NCSC staff employed and the shorter durations of these appointments in 1999-2000, the Administration estimated that supplementary provision would only be required for three of the six departments, namely CSD, ED and SWD. 18.12.00 PS The Panel discussed with the Administration on pay, fringe benefits and employment protection for government employees serving on agreement terms. [Paper]

11.01 - Hon CHAN Kwok-keung, Hon LI Fung-ying and Hon LEUNG Fu-wah jointly submitted the proposed Employment (Amendment) (No. 2) Bill 2001 to the President for ruling. The Bill essentially consisted of one clause, with the object of making EO applicable to NCSC staff employed by the Government.

14.3.02 - The President ruled on 14.3.02 that the Employment (Amendment) (No. 2) Bill 2001 jointly proposed by Hon CHAN Kwok-keung, Hon LI Fung-ying and Hon LEUNG Fu-wah related to public expenditure and Government policy, and therefore might not be introduced by Members. [President's ruling]
18.3.02 PS At the meeting when the Panel discussed with the Administration on the civil service-related issues featuring in the 2002-03 Budget Speech, some members queried whether the reduction in the number of civil servants was in fact off-set by the increase in the number of NCSC staff. 16.1.04 PS At the meeting when the Panel discussed with the Administration on the policy initiatives of the Civil Service Bureau featuring in CE's 2004 Policy Address, some members were concerned whether the additional measures needed to further reduce civil service establishment included forced redundancy and employment of NCSC staff. Some members expressed concern about the increasing number of NCSC staff employed. At members' request, the Administration provided supplementary information on establishment statistics for civil servants and NCSC staff as well as details on posts with approval for exemption from the civil service recruitment freeze. The Panel met civil service unions and received views on the terms and conditions of employment of NCSC staff.

At the Panel meeting, the following motion proposed by Hon WONG Kwok-hing was passed:
"That this Panel urges the Government to immediately study the inclusion of the posts filled by non-civil service contract staff over a period of time in the permanent establishment by converting them to posts in respect of which appointment is offered on a long-term basis, and to present the outcome of the study before July."

At the meeting, the Administration undertook to provide the Panel with a regular update on the employment of NCSC staff once every six months. The first regular update was provided in September 2005 which reported on the employment of NCSC staff as at 30 June 2005. [Follow-up Paper]

20.3.06 PS The Panel discussed with the Administration on the employment of NCSC staff (position as at 31 December 2005). The Administration would conduct a special review of the NCSC staff situation on a department-by-department basis to better understand individual department's overall manpower situation. "That this Panel expresses expressing dissatisfaction that the findings of the review of the employment of non-civil service contract (NCSC) staff conducted on a department-by-department basis have failed to treat fairly the NCSC staff who have been employed for a long period of time, and requests that:

(a)departments should conduct a review again to ensure the conversion of the NCSC staff employed to fill the posts created to meet long-term needs to civil servants; and

(b)serving NCSC staff should be converted to civil servants by 'through train'."
