  • Paper on "Proposed Arrangements for Payment of Pension to Serving Civil Servants Appointed as Principal Officials under the Accountability System for Principal Officials" prepared by Legal Service Division [Paper]
  • Administration's paper on "Retirement Arrangements for Pensionable Civil Servants" [Paper]
    SUBC reported its deliberations on the proposed accountability system for principal officials in its three reports submitted to HC on 24.5.02, 7.6.02 and 14.6.02. Deliberations of SUBC on pension payment and arrangements for serving civil servants appointed as Principal Officials were summarized in paragraphs 42 and 43 of the second report. [Report "page 12"]

    12.11.03 CQ Hon Emily LAU raised a question on the Chief Executive's (CE) exercise of discretionary power on continued payment of pensions to civil servants or judicial officers during reappointment to public service. [Hansard "page 69"]
    17.11.03 PS The Panel discussed with the Administration on the pension suspension policy applicable to retired civil servants who were re-appointed to the public service or appointed to service in subvented organizations determined to be public service for the purpose of pension suspension under the pensions legislation. [Paper]

    The Panel passed a motion moved by Hon LEE Cheuk-yan calling on the Government to review immediately the existing arrangement whereby civil servants appointed as Principal Officials under the Accountability System were still entitled to receive their pensions during their tenure as Principal Officials. [Minutes "page 11"]

    In response to the motion, the Civil Service Bureau forwarded members' request to CE's office for consideration. The CE's Office advised that the arrangement had been designed for Principal Officials serving under the Accountability System. The arrangement was endorsed by the Finance Committee of LegCo. The CE's Office considered the arrangement appropriate and did not propose to make any changes. [Follow-up paper]

    At some members' request, the Administration provided the breakdown of cases involving short-term/part-time appointments of retired civil servants to Government and gazetted subvented organizations from 1.11.00 to 31.10.03 after the meeting. [Follow-up paper]

    26.11.03 CM At the meeting when Members debated on the motion moved by Hon Fred LI on the credibility of Equal Opportunity Commission (EOC), some Members expressed grave concern that the discretion exercised by the Chief Executive on continued payment of pension to Mr Michael WONG during his appointment as the chairperson of EOC had enable Mr WONG to enjoy double benefits, i.e. receiving his pension and the remuneration as the chairperson of EOC at the same time.
