Issue No. 30 (12 July 2004)



At its meeting on 7, 8, 9 and 10 July 2004, the Legislative Council passed the following ten bills:

(1)Town Planning (Amendment) Bill 2003, with amendments proposed by the Secretary for Housing, Planning and Lands at Committee Stage.

(2)Land Titles Bill, with amendments proposed by the Secretary for Housing, Planning and Lands at Committee Stage.

(3) Education (Amendment) Bill 2002, with amendments proposed by the Secretary for Education and Manpower at Committee Stage.

(4)Adoption (Amendment) Bill 2003, with amendments proposed by the Secretary for the Environment, Transport and Works at Committee Stage.

(5) Human Organ Transplant (Amendment) Bill 2001, with amendments proposed by the Secretary for the Environment, Transport and Works at Committee Stage.

(6) Companies (Amendment) Bill 2003, with amendments proposed by the Secretary for Financial Services and the Treasury at Committee Stage.

(7) Supplementary Appropriation (2003-2004) Bill.

(8) Criminal Procedure (Amendment) Bill 2004, with amendments proposed by the Secretary for Security at Committee Stage.

(9)Professional Accountants (Amendment) Bill 2004, with amendments proposed by Dr Hon Eric LI Ka-cheung at Committee Stage.

(10)Wing Hang Bank, Limited (Merger) Bill, with amendments proposed by Dr Hon David LI Kwok-po at Committee Stage.


At the same meeting, the Council passed the following two resolutions:

(1)Resolution moved by the Secretary for the Environment, Transport and Works relating to the Food and Drugs (Composition and Labelling) (Amendment) Regulation 2004.

(2)Resolution moved by the Secretary for Constitutional Affairs relating to the Electoral Affairs Commission (Electoral Procedure) (Legislative Council) (Amendment) Regulation 2004.


The following four motions with no legislative effect were also passed by the Council:

(1)Motion on "Report of the Select Committee", moved by Dr Hon LAW Chi-kwong as amended by Dr Hon YEUNG Sum

"That this Council endorses the Report of the Select Committee to inquire into the handling of the Severe Acute Respiratory Syndrome outbreak by the Government and the Hospital Authority, and condemns the former Director of Health, Dr Margaret CHAN FUNG Fu-chun."

(2)Motion on "Facilitating communication between the Central Government and the pro-democracy camp in Hong Kong", moved by Hon James TIEN Pei-chun

"That, in order to maintain the long-term prosperity and stability of Hong Kong, this Council urges the HKSAR Government to actively facilitate better communication between the Central Government and the pro-democracy camp in Hong Kong with a view to eliminating the division and polarization in the community, and to assist the democrats, where necessary, in obtaining Home Visit Permit for Hong Kong and Macao Residents so that they can go to the Mainland to find out for themselves the economic, social and political developments etc. of our country over the years."

(3)Motion on "Big market and small government", moved by Hon NG Leung-sing as amended by Hon SIN Chung-kai

"That this Council urges the Government to conscientiously implement the 'big market and small government' principle of governance, with a view to achieving the following objectives:
(a)streamlining operating structures and procedures, enhancing administrative efficiency and creating a better business environment for the various trades and industries;
(b)preventing overlapping of functions in the provision of services by the public sector and by the relevant industries, thereby increasing investment opportunities in the market; and
(c)ensuring that government departments make optimal use of resources, minimize wastage of public funds, and eliminate the fiscal deficit."

(4)"Valedictory Motion", moved by Hon Miriam LAU Kin-yee

"That this Council concludes its work and wishes for the smooth formation of the third Legislative Council to continue to serve the people of the Hong Kong Special Administrative Region."
