An Ordinance to amend the Building Management Ordinance.

Enacted by the Provisional Legislative Council.

1. Short title

This Ordinance may be cited as the Building Management (Amendment) Ordinance 1998.

2. Appointment of management committee after application to the Authority

Section 3A(5)(a) and (b) of the Building Management Ordinance (Cap. 344) is amended by repealing "10%" and substituting "30%".

3. Notice of and voting at meetings

Section 5 is amended---

  1. in subsection (1)(c), by repealing "court" and substituting "tribunal";
  2. in subsection (2)(c), by adding "or depositing the notice in his letter box" after "flat".

4. Powers of corporation generally

Section 14(1) is amended by adding "or the renovation, improvement or decoration of those parts" after "parts".

5. Duties and powers of corporation

Section 18(2) is amended by adding--- "(fa)carry out any renovation, improvement or decoration work, as the case may be, to the common parts;".

6. Powers and duties of an administrator

Section 32(2) is amended by repealing "決定" where it twice appears and substituting "終止".

7.Composition and procedure of
management committee

Paragraph 8(2A)(c) of the Second Schedule is amended by adding "or depositing the notice in his letter box" after "flat".

8. Meetings and procedure of corporation

Paragraph 2(1A)(c) of the Third Schedule is amended by adding "or depositing the notice in his letter box" after "flat".

9. Mandatory terms in deeds of mutual covenant

Paragraph 6(2)(c) of the Seventh Schedule is amended by adding "or depositing the notice in his letter box" after "flat".

10. Terms added if consistent with
deed of mutual covenant

Paragraphs 3(c) and 10(c) of the Eighth Schedule are amended by adding "or depositing the notice in his letter box" after "flat".
