ITEM FOR FINANCE COMMITTEE
1997-98 ESTIMATES
Members are invited to -
- approve the change of titles of some Heads and Subheads of expenditure and of some Controlling Officers in the 1997-98 Estimates of Expenditure with effect from 1 July 1997; and
- note the adaptation of terms and expressions in the other parts of the 1997-98 Estimates where the context requires.
PROBLEM
The titles of some Heads and Subheads of expenditure and of some Controlling Officers as well as some terms and expressions in the 1997-98 Estimates have to be changed as a result of the establishment of the Government of the Hong Kong Special Administrative Region (HKSAR).
PROPOSAL
2.We propose to change the titles of the Heads and Subheads of expenditure and of Controlling Officers concerned in the 1997-98 Estimates of Expenditure as set out in Enclosure 1, with effect from 1 July 1997, in order to conform with the relevant provisions of the Basic Law and with the relevant stipulations of the Government of the HKSAR.
JUSTIFICATION
3.The 1997-98 Estimates of Expenditure was approved with the enactment of the Appropriation Ordinance in April 1997. The titles of some Heads and Subheads of expenditure and Controlling Officers used at that time, as set out in Enclosure 1, are no longer appropriate after 30 June 1997. We have to change them to reflect the new titles of the concerned offices and Controlling Officers to ensure that the officers concerned can properly discharge their duties under the Public Finance Ordinance (Cap. 2).
4.We have also identified terms and expressions in other parts of the Estimates that are not appropriate in the HKSAR. They need to be replaced for clarity where the context requires. A summary of these changes is at Enclosure 2 for Members' information.
FINANCIAL IMPLICATIONS
5.The proposal has no additional financial implications.
BACKGROUND INFORMATION
6.We have stipulated in paragraph 29 of the Introduction to the 1997-98 Estimates that, from 1 July 1997, we have to adapt and change certain terms and expressions in the Estimates as necessary to ensure conformity with the relevant provisions of the Basic Law of the HKSAR of the People's Republic of China and with the relevant stipulations of the Government of the HKSAR.
7.On 23 June 1997, the then Chief Secretary (now the Chief Secretary for Administration) declared, by way of notice on in the Gazette under Section 55 of the Interpretation and General Clauses Ordinance (Cap. 1), the change of titles of some public officers and public bodies with effect from 1 July 1997.
8.On 1 July 1997, the Provisional Legislative Council enacted the Hong Kong Reunification Ordinance which, among other things, has the effect of adapting some new titles and terms to current legislation.
9.The changes in titles proposed in this paper are consistent with the changes prescribed in the instruments mentioned in paragraphs 7 and 8 above.
