Legal Service Division Report on Resolution under section 7A of the Hong Kong Court of Final Appeal Ordinance (Cap. 484)

The Chief Secretary will move a motion pursuant to section 7A of the Hong Kong Court of Final Appeal Ordinance (Cap. 484) (懀he Ordinance� to seek the Provisional Legislative Council endorsement for the appointment of Lord Nicholls of Birkenhead and Lord Hoffman as judges of the Court by the Chief Executive pursuant to section 9 of the Ordinance.

2. Under section 7A of the Ordinance, the Chief Executive is required to obtain the endorsement of the Provisional Legislative Council for the appointment of judges from other common law jurisdictions appointed pursuant to section 9 of the Ordinance.

3. No information on the two persons whose names are specified in the motion has been received at the time when this reports is prepared.

4. The legal and drafting aspects of the resolution are in order.
