Food Business (Regional Council) (Amendment) (No. 3) Bylaw 1998 (L.N. 1)


This Bylaw classifies meat to be eaten in raw state as restricted food. The effect is that except with the permission of the Provisional Regional Council, no such food may be sold, exposed for sale or possessed for sale or for use in the preparation of any food in the municipal area under the jurisdiction of that Council.

In the municipal area under the jurisdiction of the Provisional Urban Council, such food has already been classified as restricted food since 1996.

This Notice appoints 15 January 1999 as the day on which sections 16 (Prohibition on practising when not registered or not in possession of a valid practising certificate), 25(1)(h) (contravention of section 16) and 31 to 44 (Consequential Amendments) of the principal ordinance shall come into operation.

The rest of the principal ordinance have already come into operation on various dates since 14 July 1997.

These 3 sets of Regulations are made to replace their earlier versions made in 1997 (L.N.s 557 to 559 of 1997) because the latter have been wrongly made by the Chief Executive in Council, not being the authority so empowered under the principal ordinance. These Regulations should have been and are now properly made by the Secretary for Health and Welfare.

These Regulations will all come into operation on the day section 16 of the Veterinary Surgeons Registration Ordinance (Cap. 529) comes into operation, i.e. 15 January 1999 (please see L.N. 3 above).

The purpose of these Regulations is to adapt consequentially the references to veterinary surgeons in their principal regulations to tie in with the said section 16, which provides that only a registered veterinary surgeon with a valid practising certificate can practise veterinary surgery or provide a veterinary service in Hong Kong.
